It's important to remember that this is a contextual definition.  The
context is license analysis so that we can know whether or not we are
upholding our pledge to the Free Software Community that Debian will
"remain 100% Free Software".

Yes, there is some circularity in this.  Statements of first principles
often have this feature.

The debian-legal mailing list need not waste its time arguing with
people about "what software is" in *any other* context.
