In order to add that responsibility to the automobile, one would have to introduce new features.
Starting to get way OT, but... automobiles are "charged with" meeting certain safety standards (maintaining structural integrity under specified impacts, deploying airbags, etc.). When an automobile fails to perform under stress, insurance companies and lawyers often try to make that "charge" very literal.
