You can't really take it from copyright text.  I only mention it because 
the author lists "change the license" as an action he might take, and it's 
unclear what he means by that.

Technically so, but his comments seem to indicate that he thought it was a
requirement all along.  If this is the case, we should honor his wishes by
not distributing the software.
