As just mentioned in another mail, OSM explicitly allows the data in it
to be sold (although one wonders why anyone would be willing to pay,
unless someone's done a load of extra work in post-processing the data,
in which case charging seems fair enough).  In other words, it's pretty
normal to make a living out of selling other people's work in Free
Software land, and if one helps out by making it better at the same
time, then everyone wins, which seems pretty moral too.

BTW It might be worth actually checking back with the people providing
the data whether they'd be OK with us uploading it to OSM, because at
the moment we seem to be assuming that they'd not because they've said
no selling of it, but the thing they're really selling to garmin is the
right to use the data without any extra conditions -- if the data was
incorporated into OSM, it would then be covered by the OSM license,
which (excepting that there are some arguments about whether CC licenses
actually make any sense on map data) should stop anyone being allowed to
take the data out again, and sell a similar "Do what you want" license
to someone like Garmin, because they'd instead have to explain the CC
license to Garmin, which would not get them any money, because Garmin
don't want references back to OSM on their devices, and they don't want
to have to trust a bunch of map-making hippies ;-)

That being the case, I think the original owner would retain the
exclusivity that they seem to care about, even if we did upload the POI
data to OSM -- if that's true, then we can just pick out the more
interesting POIs and put them into OSM as we see fit.
