I'm sure the other replies are right, but just to let you know,
nycwireless.net does something like this where you need to agree to
their terms before accessing the net. They have some mailing lists on 
their site, & everybody I ever met from the organization was very 
helpful. 

The one time I used one of their links I was sharing a wireless card 
with a friend who had another laptop & whatever check they did seemed 
based on the card's ID because between us we only had to agree once.
