No, it's entirely fair to complain to people who do the wrong thing. (I only wish that such complaints were done off-list, rather than complaining to the people who do the wrong thing _and_ every other list subscriber. I firmly believe that one person getting an annoying duplicate is much less terrible than _everyone_ getting this old, tired flamewar every 6 days.) In theory, everyone on the list should have read the list rules before subscribing.
