IIRC, the answer is at this point "both"...  Mirabilis did release
documentation on the protocol.  That's what led to discovery of a couple
of security holes in their server (which were fixed of course, but would
have been fixed a lot sooner had they published their server...)

You could ask AOL to publish their server's source if you want to, but I
doubt they will.  The fact that AOL now owns both standards in instant
messaging has sparked a project to create a free ICQ server.  I'm glad a
little good old fashioned paranoia in response to a potentially
monopolist action is going to result in us getting another piece of free
software.  =>
