Here is a scenario (similar to a real situation I saw recently):
A legitimate client receives a chain letter advertising spam sending
methods. He/She thinks this must be something cool and sends a bunch of
copies forward. He/She does not know that it is bad behaviour.
No admin could possibly find out about this spam without complaints.
At some point n minutes later both the black list and the hosting ISP
receive complaints. If we assume that size does not matter, what should be
done?
a) The ISP is now a spam source, but I do not feel it justified to blacklist
it immediately.
b) The customer did not know any better and could be educated. Perhaps his
email service could be frozen until the ISP has a talk with him.
To me the problem seems to be that it is difficult to predict if the ISP can
stop the spam or not.
As an administrator for email service I am not terribly thrilled about us
being responsible for what our clients do. Of course we cut the access if
they misuse network resources (like spam), but I would like to leave it at
that.
The nice thing is that Finnish law on direct marketing requires that
all automatically sent advertising such as email, sms or fax can only be
sent to an individual after he/she has given a permission for that.
Therefore all Finnish spammers can be taken to court (I have a personal case
in the system against the biggest Finnish telecom).
