The NMUer has to send the patch of the NMU to the maintainer, either
through the BTS or directly, yes.

Policy doesn't rule the NMUs. There's no rule for NMUs, just
guidelines ... and the guideline during a BSP are "NMU without prior
notification but upload to DELAYED in order to leave some time to the
maintainer if he's not happy with the NMU".

You should stop complaining about the NMU, the perl 5.8 upgrade has
been announced twice on debian-deval-announce.

If you were a good maintainer, you would already have uploaded a fixed
package compiled against perl 5.8 and you wouldn't have had a single
problem.

So please ... don't complain about NMUers when they are only trying ot
help you !
