That's a valid point. It should be discussed on debian-live, i guess.

Google shows me that the problem can be avoided with persistent systems:

But with a Live system the problem arises that it must know whether
the hardware clock is meant to be set to UTC or to local time.
This depends on what the previously booted OS did to that clock.
So probably a Live system would have to ask the user about the local
hardware clock habits.
(The Archlinux wiki briefly mentions that newer EFI could know the
timezone of the harware clock.)
