Cisco's kernel driver (as of version 3.7.2) consists of a small
open-source compatibility layer and a large binary-only part. I
think that is the concept Nvidia uses as well.
The user space software comes binary form, too.

I believe so. But I would be reluctant to be proven wrong, because
this would mean I could perhaps replace cisco's client by freeswan
here.
