Thanks for help, I tried all that but i've discovered the problem
after i ssh to the host, I run scp from the SAME TERMINAL i didn't know "or imagine" that it's wrong
now i understand that's complaining about the missing file ON THE SERVER not on my local machine since it's runned from there
don't flame me for that! enuff the 6 hours i spent till i knew that i have to run it from an xterm :-)
