problem with scp

Hi, 
Sorry for bothering you with my stupid questions

i'm trying to use scp to copy some files from my local host to another host "ssh ed to it"
I get
 No such file or directory
though the file is there

$ scp /tmp/file uniball@host.com:~/
uniball@host.com's password: 
/tmp/file: No such file or directory

ls -lh /tmp/file
- -rw-r--r--    1 mohammed mohammed     728k Jan 25 18:40 /tmp/file

I really don't understand the idea !
searched google and had a look at the man pages but i didn't find any info.
