It works fine with 2.6.11.8 !

Now I want test it, but at moment I've not a swap partition :(
This patch works with a swap-file?

P.S.
I've tried 'echo disk > /sys/power/state' without any swap and my screen becomed crazy! 
(really, blinking colors - red and blue -)
