That works only if they don't distribute libssl with it.

For example, putting a quaga w/openssl .deb in a general purpose 
"local mirror" would be a problem, probably giving it to someone on
an install dvd would be a problem, but building a copy for a friend 
(and nothing more) wouldn't be.

But you're right that that exception will be valid in some cases.
