I think a determination needs to be made about whether it can even be
distributed in non-free. This post:

http://lists.debian.org/debian-legal/2006/01/msg00150.html

suggests that failure of DFSG 9 means it can't go in non-free. The
offending clause is:

> iv)	You are not permitted to use Software Product for development or
> distribution of "Server Software" that provides services or 
> functionality on a computer acting as a server.

This places a restriction on other software distributed with libecw.
