The 'non server' condition has been removed indeed in 3.3rc2, you will
find:

'Revised  8th June 2005 - Removed server restriction from GPL License'.

So condition 9 is respected currently. I'm not completely persuaded
that it is distributable as non-free, anyway. But I'm not a d-legal
expert...
