No, it's not valid. # comments are not allowed in control files other than debian/control. See last but one paragraph of Policy §5.1.

Please note that adding a machine-readable header section does *not* force you to rewrite the whole copyright file: You are free to add non-machine-readable chunks below the machine-readable parts.

If you don't mind lintian warnings…
