If it had been patented, the details of it would have been publically
known without cracking it which would have reduced its effectiveness.
However, it is an illegal copyright circumvention device under the DMCA
in the US, and is probably also illegal within the UK under the
Copyrights, Designs and Patents act 1988. I believe that it will be
under much the same status in the rest of the EU once the EUCD is
implemented, but this may depend to some extent on how different member
states implement it.
