How does one know that the maintainer should know whether it can go
on a CD, and who would take responsibilities for it if it were "wrong"?

A CD-Rom vendor needs to check whether a non-free program can go on a CD-Rom,
and anyway, non-free is there for a reason, and "it's not part of Debian".
