dpkg bug?

I'm testing the upgrade from smartlist 3.10-16 to 3.10.7-4.

I have found a "little" problem: it seems that when a conffile is
automatically replaced by a newer one (because it has not been modified),
any hard links to that conffile are "destroyed" (i.e. only the conffile is
replaced, not the links, and they are not linked anymore).

This behaviour is sub-optimal, because the user is usually interested 
in having the files in the already created lists to be still linked to the
new versions in .etc.

Could we consider this a bug in dpkg? If not, should we clearly write in
policy that hardlinks to conffiles should be avoided wherever possible?

p.s. Yes, smartlist 3.10.7-4 does already uses symlinks and not hardlinks,
but this is still a problem for already created lists.
