It's a long-standing bug, see for instance,

I don't remember whether I ever blogged about it, but I found I could
use dd to dump the partition table segments and use those to restore
Mac OS9 bootability when the CD driver restore wouldn't work (as in
when using a non-Apple drive).

Another factor was the size of the drive involved, for me. Tangerine
clamshell, and the ROM was written with the assumption of max 120G HD.
Using a 160G HD made it harder to keep the MAC OS-9 partition
bootable.
