Why not remove the package from testing, same as any other release critical bug?
Or if you are worried about unstable containing non-DFSG stuff, why not remove the package altogether, and allow somebody to upload to non-free if deemed appropriate?
I think automatically moving it to non-free may not always be the best solution.
