The non-OSE is only for specific bits, like USB support, which is not to my knowledge in QEMU, since it was added by Innotek or Sun.
I think this is a legal matter, which I am not qualified to answer (and I haven't read anything about it.)
I expect that Oracle will remove code from QEMU over time. I expect (and be delighted to be wrong about) that Sun and Oracle will fork VBox and close off the non-OSE version. This is pure speculation.
