Are you absolutely sure that all the processes using the CD drive were
killed?  If the process went to sleep and was never schedule to run again
then it wouldn't have gotten killed even with a kill -9. (This is possible
with hard drives I know). The other problem could have been in hardware,
which might be avoidable with a software fix.  The second case would be
worth a bug report.
