I think I've missed some parts of this conversation, so apologies if the
following is not relevant.

Sun now seem to be very keen to license their software openly. I contacted
them about the JavaCC product which claimed to be a BSD-license but had
the restrictive "Nuclear", "Non-export" etc clauses in it[1]. They were
very helpful and responsive.

If Sun hold the copyright on the package in question, I suggest you
contact them on: ombudsman@sun.com - where people can address concerns and
issues to Sun.
