i used current snapshots, precisely 2.0~a3+20091223.212718 from
live.debian.net/debian, and i could not reproduce it.

my config tree looks like this:

# find
.
./binary
./source
./common
./bootstrap
./chroot_local-includes
./chroot_local-includes/etc
./chroot_local-includes/etc/foo.conf
./chroot
#

...and /etc/foo.conf was properly included in the resulting live system.
