It may imply this, but this is not a barrier to Debian's inclusion of the packages under the current non-free regime. The only real requirement for a package's inclusion in non-free is: "can we distribute it?" We don't make any guarantees that other people can also distribute it outside of a Debian mirror, or on CDs, or anything else.
