Not exactly. In the case where there aren't any interesting patents, which is the normal case, there's no problem. A bunch of stuff is in the archive on that basis. It's difficult to say what would happen if something were to come up which actually invoked the patent clauses; we never really pursued that very far. Note that this license is obsolete, and nobody who is not IBM should use it.
