There were three cases, not two.

One was GPL, one was non-commercial and one was commercial.

If this were equivalent to three licenses on the software (one being GPL,
the other two being irrelevant for our purposes), with the user picking
the relevant license, that would be fine.

If this were equivalent to a statement that the user is not allowed to
pick the GPL in some circumstances, that wouldn't work -- but I didn't
see anything to indicate that.
