I'd let the language lawyers argue that ones for days. Apple has touched
(at least 'marketed') a fair number of OSs, including at least two Linux
ports. I would be surprised if no Apple code is in the vger kernel tree.
They have also helped develop at least one (MkLinux).

They have licenced technology to Microsoft for Windows. They played with
their own UNIX for a while.

I wonder how large a hole in that license there is. /me thinks you could
fit quite a bit through it.
