i wrote to the author and he changed :

 * Redistribution and use in source and binary forms are permitted
 * provided that the above copyright notice and this paragraph are

to :

 * Redistribution and use in source and binary forms, with or without
 * modification, are permitted provided that the above copyright notice 
 * and this paragraph are

That would take care of the first problem, what about the advertising material
stuff, i guess it is not compliant with 7 of the DFSG, altough even there, it
should be ok, this is only a nuissance, isn't it ?
