IANAL.
But:
1. The _ham_ question pools are developed by the NCVEC, not the FCC. If
commercial exam questions are developed outside of the FCC, that could
be a problem, but I can find no evidence of the existence of an
organization like NCVEC for commercial exams. In contrast to the
commercial pools, The FCC site specifically states that an outside
organization maintains the ham questions, and does NOT provide those
pools for download.
2. US copyright law states that works by the US Government are not
elegible for copyright protection.
