Besides, when changing APIs and breaking interaction with other
programs that rely on the original API.

You are right when the fork is API compatible (like extension of
a library that provides the same API plus something more), but 
*not* when changing the API.

In this case, me too, would consider it *incorrect* (I don't want to
use "unethical" as it is difficult to define).
