I must have missed this before:

The license on Caldera's own software does.

Specifically, the license on Caldera's demo CD could not have forbidden
me from packaging a version of sysvinit with the "cripple patch"
disabled, meaning that I could then use the demo CD without paying
Caldera a dime.

I could, indeed, even distribute my patched sysvinit (as long as I also
provided source, etc.).

And if Caldera tried to then litigate against me for violating the
license on some other piece of software bundled with sysvinit ("you
can't use Caldera FooBar on a system without the special Caldera
sysvinit"), then the copyright owner for sysvinit (Miquel?) could then
sue Caldera for violating the sysvinit license.

That's the way the GPL works.
