The thing that is most widely patented with Audio MPEG is what is known as
the Psycho-Acustic model that the encoder uses to generate the output. As
I understand it that algorithm is designed from painstaking trail runs
with audiophiles to get the best quality - I hear there are several
available, some with patent protection and some without.
In any event audio mpeg decoding is just a series of well-known
mathematical transforms and I don't belive it is patented in any way.
