The text you forwarded fails #3 and #6 of the DFSG.

I would suggest that you ask the author to consider offering the program
under the GPL. That would allow use of the program in a "literate
programming" editor, but only a free software one. The author is
welcome to sell other licenses to people who want to use the product
commercialy under different terms than the GPL.
