You can release it without the BIOS, perhaps requiring a BIOS image to be
in /tmp before you install, like the netscape installer does.
Anyone who has a real c64 has a licence to use the BIOS; if they don't use
the emulator at the same time as the real c64 then it is legal for them to
take a rom image from it.
