I maintain the atari800 package, that has the same problem. My approach was
to put it in the main distribution, and just put a note in the README.debian
that it's useless without the roms (and tell where you can download them
from if you already have a licence for them (ie, if you own an atari 800))

Looking at this for a second time, I'm not sure if my atari800 package
belongs in main or in contrib. It does depend opon a non-free item, after
all. Anyway, your package should at least go into contrib, if you don't
include the non-free roms in it.
