The general policy is that if it would be easy for a vendor to run
afoul of the license of a program, it belongs in non-free. The CD-ROM
producer gets to look at the licenses of programs in non-free
individually, and decide what to place on their CD. Many Debian CD-ROM
producers will distribute non-free programs.
