when loading the preseeding file from kernel parameters I.E: file=/cdrom/preseed.cfg
the line "d-i console-keymaps-at/keymap select es" of the preseeding file is ignored
this doesnt happen with initrd preseeding

Of course it is ignored. The preseed file is loaded _after_ the relevant 
component has already been run.
To get the setting used you have to use the "auto" mode.

All this is documented in the relevant appendix of the installation guide.
