the hyperref manual says in section 5.3, Backend drivers:

However, the following document gives different output depending on
whether the first or second line to load hyperref is used with
LaTeX. With hypertex, one gets hyphenation in the toc, as if breaklinks
were true. Without, the behavior is the same as if dvips is loaded as
backend driver, i.e. no broken links, no hyphenation in the toc.
I don't know whether you want to change the code or the documentation,
but currently both don't fit together, it seems.
