Not true; questions like this are frequently decided in the early phases
of civil trials, and not always in favor of the plaintiff.  "Standing"
is a legal concept and a matter of law that is litigated by attorneys
and decided by judges, often with reference to statutes which *define*
standing in various types of cases.

Please consult a legal dictionary.
