"Legal Terms of Service" advice please



I've written a script to query Geocrawler's Debian archives from
the command line rather than their web interface.  I'm modifying
the script to add features and noticed the following blurb on
their site; http://www.geocrawler.com/legal/

                          Legal Terms of Service
   
   Viewing these pages or using any of the information contained herein
   indicates you accept and agree to be bound by the following terms. 

   You agree to indemnify, defend, and hold harmless Geocrawler.com, VA
   Linux Systems, and all related services from any and all liability,
   penalties, losses, damages, costs, expenses, attorneys' fees, causes
   of action or claims caused by or resulting indirectly from your use of
                              this service.

   Use of this service is on an "as-is" basis. ALL WARRANTIES,
   INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF FITNESS FOR
   A PARTICULAR PURPOSE AND MERCHANTABILITY, ARE SPECIFICALLY
   DISCLAIMED. Any contact with any agents of this service,
   either in person or through electronic means does not create a
   warranty.

The second paragraph is a little scary.  It would seem prudent to
ask for permission to distribute the script, yes?  It's a little
late though.

I'd expect to get permission, given the company.  Any advice on
how to word the email?

Email replies ok but I'm on the list.
