I recently upgraded to Version: 0.0.23-2 and I am using xmlto all day long and
I have not seen this.

On the other hand, I ran "xmlto --skip-validation txt conftest.xml"
with a zero byte conftest.xml file and I have the same bad results as you do.

Looks like like you have a patch, can you post it?
