I have no recent kernel yet to reproduce it with such. However, the fact that etch ships no 2.4 kernels does IMHO not mean that etch packages do not need to run on 2.4. So downgrading this bug's severity is IMHO not reasonable. However, I'll leave it up to you to re-raise the severity if you agree with me.
