Bug#149383: squeak licensing



Hi Andreas,

I am looking at your ITP for Squeak.  I was surprised to see the cutting
short of the license from the last time I looked at this, and I went
investigating.

I downloaded the source tarball: Squeak-3.2-4.src.tar.gz

Looking at the file LICENSE in platforms/unix/doc in that tarball, it would
seem that the license has not in fact changed and still has the following
clause 5:

5. Indemnification.  You agree to indemnify and hold Apple harmless
from any and all damages, liabilities, costs and expenses (including
but not limited to attorneys' fees and costs of suit) incurred by
Apple as a result of any claim, proceeding, and/or judgment to the
extent it arises out of or is connected in any manner with the
operation, use, distribution or modification of Modified Software, or
the combination of Apple Software or Modified Software with other
programs; provided that Apple notifies Licensee of any such claim or
proceeding in writing, tenders to Licensee the opportunity to defend
or settle such claim or proceeding at Licensee's expense, and
cooperates with Licensee in defending or settling such claim or
proceeding.

This clause has prevented us from distributing Squeak in the past...a
similar clause prevents us from distributing J2SE.  I strongly recommend
that you talk to Apple (or someone) about this.  Perhaps you will have
better luck with them than I did.  (the limitations on fonts in clause 2
probably puts it in non-free anyway, but it isn't any kind of showstopper
like this clause is)

It's a pity, it looks as if Alan Kay has finally realised his 30 year old
dream for smalltalk.  I'm impressed with how good it looks from the
screenshots.  I will be getting it to play with properly tomorrow when I am
at work and have proper bandwidth.

Perhaps this LICENSE file is just left over from an earlier time, and Apple
have in fact relicensed.  I really do hope so, I would love to see this in
Debian.
