Whom the bugreport hast to be sent? The kernel-header maintainers? The third-
party? 
IMO third-party should maintain their code and fix the issue.
If third-party would determine that this issue is not their fault, then they should report a regression bug upstream, explaining the problem in technical detail and/or offer patches.
