Re: Confusion about legality of Linux

Did the alleged demonstration of Linux and free distribution of Linux
disks actually take place:

a) in a school classroom or other space for pedagogic activities under
the jurisdiction of a school during a period when such activities were:

	1) in progress or scheduled, or

	2) not in progress or scheduled, or

b) elsewhere in space under the jurisdiction of the school, where the
general public:

	1) is only admitted on invitation, implicit or explicit, or

	2) normally has or can have access, implicit or explicit?

In order to determine the respective rights and responsibilities of the
teacher and the students these questions need to be answered. Many
posts to this thread assume that situation (a)(1) obtained and
consequently defended the teacher's actions. If any of the three other
situations obtained she could very well have exceeded her authority and
would consequently be liable for doing so.

In any event, from the information given in the blog, it would seem in
any case that she had neither the right to confiscate the disks nor
immunity from any libel or slander action brought by Ken Stark.
