NACK, similar works fine for me:

gs  -q -dNOPAUSE -dBATCH -sDEVICE=pswrite -sOutputFile=bla.ps -f 1.ps 2.ps
gs  -q -dNOPAUSE -dBATCH -sDEVICE=pdfwrite -sOutputFile=bla.pdf -f a.pdf b.pdf
